Partai Rentals LLC Rental Agreement

  1. Customer Responsibility

a.  Rental Period

  • The Customer is responsible for all rental equipment from the time it is delivered or released to the Customer or authorized representative until it is returned to, inspected, and accepted by Partai Rentals LLC.
  • Equipment must not be tampered with, dismantled, misused, or abused during the rental period.
  • A responsible adult must supervise equipment at all times to ensure proper usage and safety.

(A standard rental period is 24 hours unless otherwise specified. Delivery and pickup or pickup and return times determine the start and end of the rental period.)

b.  Securing Equipment

  • Customers must secure equipment when not in use.
  • Protect equipment from adverse weather conditions.

c.  Reporting Problems

  • Notify Partai Rentals LLC immediately if equipment is broken or missing upon delivery.
  • Do not attempt to fix or adjust equipment yourself; Partai Rentals will handle all repairs.

d.  Professional Conduct

  • Maintain honesty, respect, and integrity when interacting with Partai Rentals LLC.
  • Report damages truthfully and make payments timely.
  • Maintain general good conduct in all interactions.

e.  Damage or Injury

  • Customers are fully responsible for any damage or injury occurring during use of equipment.
  • Customer agrees to pay for any damages outside of the optional Damage Waiver (Section 6).

     

2. Equipment

    a.  Condition

  • Equipment is released in good condition and must be returned in the same condition
  • Ordinary wear and tear is expected.
  • Beverage/food items must be rinsed free of residue.
  • Beverage and food rental items must be rinsed and free of residue before pickup.
  • Linens must be free of garbage or stains.

    b.  Restrictions on use

  • Equipment may not be loaned, sublet, disposed of, or used at another location.

     c.  Right to repossess 

  • Partai Rentals LLC may repossess equipment if contract is breached.
  • Examples of breach:
  • Not allowing pickup access.
  • Using equipment at a different location.
  • Failure to maintain good conduct with staff.
  • Authorities may be notified if equipment is not returned.

      d.  Release of liability

  • The Customer assumes full responsibility for all rental equipment upon delivery or release of equipment to the Customer or authorized representative and remains responsible until the equipment is returned, inspected, and accepted by Partai Rentals LLC.
  • The Customer is solely responsible for any injuries, damages, or losses arising from the use, handling, transportation, or possession of the rental equipment during this period.
  • Partai Rentals LLC is released from claims, or damages are limited to total rental fees if release is unenforceable.

    e.  Replacement cost for damages

  • Customer agrees to pay full replacement cost, including labor, for damages outside the Damage Waiver (Section 6).
  • Replacement cost applies to lost, stolen, or irreparably damaged items.
  • Costs are calculated at current replacement value, including labor and shipping if applicable.
  • Optional damage waiver (Section 6) may cover minor accidental damages, subject to waiver terms.

 3.  Company Delivery/Pick Up 

a.  Delivery

  • Base delivery fee: $50, plus $0.76 per mile (two round-trips).
  • Includes delivery to first-floor docks, garages, or within 25 feet of the truck.
  • Extra charges for:
  • Stairs: $25–$50 (per number of flights, 13–16 steps per flight).
  • Elevators: $20.00.
  • Extended carrying: $25–$50.
  • Non-paved or difficult terrain: $25–$50.
  • Delivery staff will stack items in an accessible location.
  • If a customer approves leaving equipment unattended, confirmation must be sent via email/text. Equipment left is the customer’s responsibility.
  • A thirty (30) minute grace period is provided for Customer or authorized representative to arrive for equipment release. 
  • If the customer or authorized representative is not present within the thirty (30) minute grace period, a $25 late arrival fee will automatically be applied. 
  • If delivery cannot be completed within the grace period due to Customer unavailability, the attempt will be considered a missed delivery. All delivery fees and service charges remain non-refundable once dispatch has occurred, and the Customer remains responsible for the full rental order.
  • Any rescheduled delivery is subject to availability and may require additional fees. 
  • Same-day delivery may be available based on scheduling and availability. A $50 expedited service fee applies. Deliveries requested outside standard delivery windows may incur an additional fee of $50–$150, depending on timing, distance, and operational requirements.

A missed delivery attempt does not cancel the order and does not relieve the Customer of payment obligations

b.  Pick Up

  • The Customer must ensure that all rental equipment is fully accessible, organized, and ready for pickup at the scheduled pickup time.
  • A thirty (30) minute grace period is provided. If equipment is not ready for pickup within this time, a $25 missed pickup / delay fee will automatically apply.
  • Additional charges will be assessed in four (4) hour increments at a rate equal to 50% of the total daily rental rate per item or package (or portion thereof) until the equipment is made available for pickup.
  • If the delay exceeds twenty-four (24) hours from the scheduled pickup time, the rental will convert to an additional full daily rental charge per item or package for each calendar day (or portion thereof) the equipment remains unavailable.
  • The Customer acknowledges that delayed pickup may impact scheduled deliveries and other rentals and agrees to all resulting charges until all equipment is successfully collected by Partai Rentals LLC.
  • Pickup requests outside of available time slots are subject to availability and may incur an additional fee ranging from $50–$150 depending on timing, staffing, and scheduling impact.
  • The Customer remains fully responsible for all rental equipment until it has been retrieved, inspected, and accepted by Partai Rentals LLC.

For the purpose of this Agreement, ‘ready for pickup’ means all equipment is properly cleaned (if applicable), organized, and placed in an accessible location within the agreed pickup area.

c.  Set up

  • Set up/take down of canopies and tents is included in the rental price for canopies. Tents may require additional installation fee.
  • Table and chair set up/take down available for an additional fee with advance notice:
  • 1–5 tables / 6–30 chairs: $50
  • 6–10 tables / 31–60 chairs: $100
  • 11–15 tables / 61–90 chairs: $150
  • 16–20 tables / 91–120 chairs: $200

d.  Digging/Staking

  • Customers are responsible for marking safe locations for staking canopies/tents.
  • Contact Arizona 811 Center at least 2 working days prior to rental to mark underground lines for free.
  • This ensures safety of customers, staff, and equipment.

e.  Delivery and Pickup Outside of Business Hours

  • Special requests outside standard delivery/pickup hours may incur an additional $50–$150 fee (fee reflects additional labor, scheduling adjustments, or multiple trips required).

4. Customer Pickup & Return

a.  Pickup

  • Pickup and return times are selected during booking from available time slots.
  • All pickups take place at the designated location and occur at the front entrance. This location is not a retail storefront or office.
  • The individual who completes the booking (“Customer”) must be present at pickup or must designate an authorized representative in advance. Partai Rentals reserves the right to request valid identification prior to releasing equipment.
  • By accepting possession of the rental equipment, the Customer or authorized representative acknowledges that all items are received in good condition and agrees to all terms and responsibilities outlined in this Agreement.
  • Partai Rentals LLC is not responsible for any damage, injury, or loss occurring during customer loading, transport, or unloading of equipment.
  • A 30-minute grace period is provided for scheduled pickup appointments. If the Customer or authorized representative arrives after this grace period, a $25 late pickup fee will automatically apply. Failure to arrive within this window may result in a missed appointment and rescheduling based on availability.
  • All applicable fees must be paid prior to release of equipment. 

b.  Return

  • All rental equipment must be returned at the scheduled return time selected during booking, unless otherwise agreed in writing by Partai Rentals.
  • Equipment may be returned by the Customer or another individual; however, the Customer remains fully responsible for all equipment until it has been returned, inspected, and accepted by Partai Rentals.
  • A thirty (30) minute grace period is provided for all scheduled returns.
  • Returns exceeding the grace period will be charged in four (4) hour increments at 50% of the total daily rental rate per increment (or portion thereof).
  • Charges will continue to accrue in 4-hour increments until all equipment is returned and checked in by Partai Rentals.
  • Total late charges for any single rental period will not exceed one (1) additional full rental day per item or equipment package per calendar day delayed.
  • The Customer remains fully responsible for all equipment until it has been returned, inspected, and accepted by Partai Rentals.
  • Any missing, damaged, or unreturned items will be charged at full replacement cost.
  • All late fees, damage fees, replacement costs, or any additional charges assessed after return inspection must be paid by the Customer. If the Customer chooses to leave before inspection is completed, the Customer acknowledges and agrees that inspection will be conducted after departure. The Customer authorizes Partai Rentals to complete a post-return inspection without the Customer’s presence and agrees that final charges may be assessed and charged to the original payment method on file. The Customer remains financially responsible for all charges associated with the rental until final inspection and closure of the rental agreement is completed.

5.   Obligation and Authorization

a.  Agreement

  • The Customer agrees to comply with all obligations, policies, and financial responsibilities associated with any payment method used for this rental.
  • This includes, but is not limited to:
  • Initial rental payments at the time of booking.
  • Additional charges or adjustments during or after the rental period such as, late fees and any extended rental charges assessed under both the Delivery & Pickup and Pickup & Return Policy.
  • Waiting fees and/or scheduling disruption fees 
  • Any additional charges or adjustments incurred during, after, or as a result of the rental period, including post-return inspection findings.
  • These obligations apply regardless of whether charges occur at booking, during the rental period, at delivery/pickup, at pickup/return, or after equipment inspection and check-in.
  • Partai Rentals LLC is authorized to collect any outstanding balances owed under this Agreement in connection with the rental order until the account is fully satisfied and closed.

b.  Authorization

  • The Customer authorizes Partai Rentals LLC to charge the payment method on file for any amounts owed under this Agreement, including but not limited to:
  • Full or partial payment of the total rental invoice.
  • Late fees related to delivery/pickup and/or pickup/return 
  • Extended rental charges, or additional day charges
  • Charges related to damages not covered under the optional Damage Waiver (see Section 6).
  • Any additional charges or adjustments incurred during, after, or as a result of the rental period, including post-return inspection findings.
  • Same-day cancellation fees, in accordance with the Cancellation Policy (Section 7).
  • Waiting fees or scheduling disruption fees associated with delivery/pickup or pickup/return delays.
  • The Customer further authorizes Partai Rentals LLC to complete post-return inspection after the Customer has vacated the premises and to charge any resulting balances, including late fees or damage assessments, even if the Customer is not present at the time of inspection.
  • This authorization remains valid until all rental charges are fully paid and the rental agreement has been formally closed by Partai Rentals LLC.      

6. Damage waiver

a.  Non-Refundable and taxable fee

  • Optional damage waiver fee: 10% of the total rental invoice.
  • Fees are taxable and non-refundable, regardless of whether damage occurs.
  • Must be selected at the time of booking or in the cart to be applied.

b.  Coverage details

  • Covers accidental damage to rental equipment.
  • Covers normal wear and tear within the rental period.
  • Does not cover negligence or intentional misuse.
  • Provides relief for minor damages to rental items.
  • All broken items and parts must be returned to Partai Rentals LLC for coverage to apply.
  • Does not cover installed canopies/tents, except for weather-related damage covered by Partai Rentals.

c.  Exclusions

  • Does not cover missing items, theft, or vandalism.
  • Does not cover damage caused by negligence, abuse, or improper use.
  • Replacement cost for missing or negligently damaged items will be billed at current replacement value.
  • Damage to installed canopies/tents due to customer action, including moving or altering, voids the damage waiver.
  • Damage to installed canopies/tents from inclement weather remains the responsibility of Partai Rentals LLC, not the renter.

(Selection of the Damage Waiver does not eliminate the Customer’s responsibility for proper use and care of equipment.)

7.  Cancellation

a.  Timeframe

  • Customers must cancel 7 business days or more prior to the scheduled rental date to avoid a cancellation fee.
  • Refund of down payment (50% of total rental invoice) is allowed if canceled within this timeframe, minus any processing fees.
  • Cancellations less than 7 business days prior to the event date incur a 50% cancellation fee (down payment), non-refundable.

b.  Same day cancelation

  • Cancellations on the same day as the scheduled rental incur 100% of the total invoice.
  • Partai Rentals LLC is authorized to charge the remaining balance if not already paid.
  • Policy compensates for reserved equipment that could not be rented to other customers.

c.  Right to cancel

  • If cancellation occurs due to customer breach of contract, failure to comply with rental terms, unsafe conditions, non-payment, misrepresentation of event details, failure to provide access for delivery and/or pickup, or refusal to cooperate, Partai Rentals LLC reserves the right to cancel the rental. In such cases, payments made may be retained as liquidated damages to cover reserved inventory, labor, administrative costs, and lost booking opportunities. If cancellation occurs after equipment has been delivered or made available, no refunds will be issued and the full invoice balance remains due. The Customer authorizes any additional charges resulting from a breach of this Agreement to be charged to the payment method on file.
  • If Partai Rentals LLC cancels a booking for any reason not caused by the customer, the customer will receive a full refund of all payments made, including down payments and fees. If cancellation occurs after delivery, a prorated refund will be issued based on unused rental time. Partai Rentals LLC reserves the right to cancel due to circumstances beyond its control, including but not limited to safety concerns, equipment failure, weather, emergencies, or operational limitations. Additional courtesy accommodations may be offered at the company’s discretion.

(Processing fees are non-refundable in all cases.)

8.  Photo usage

a.  Permission 

  • Renter allows Partai Rentals LLC to use images of rented equipment for:
  • Marketing campaigns
  • Advertisements
  • Company websites or other promotional content
  • Permission includes any photographs, videos, or digital media captured during the rental period.

9. Payment Terms

a.  Payment Due

  • Balance due 7 business days prior to event date
  • Non-payment may result in cancellation or delivery delay.
  • The website accepts online bookings within 5 days of the event date, which is less than the standard 7-business-day cancellation period. For these short-notice bookings, full refunds are not guaranteed. Refunds will be handled minus any processing fees.
  • For bookings made within 5 days of the event date on the website, only the 50% down payment is required at the time of booking. Because these bookings are less than 7 business days from the event, a separate email will be sent confirming that full 100% payment is due in accordance with the Payment Due Policy.
  • If the remaining invoice balance is not paid 7 business days before the scheduled delivery date and time, it will be considered a cancellation and equipment will not be successfully delivered unless advance arrangements have been communicated with ‘Partai Rentals LLC’. The renter FORFEITS the down payment (50% of total rental invoice) paid at booking/scheduling.

b.  Charges

  • Partai Rentals LLC may charge any payment method provided for:
  • Full or partial invoice payment
  • Damages outside optional Damage Waiver (Section 6)
  • Additional equipment or service fees outside original agreement
  • Additional daily rental charges if equipment not returned on time (Section 3)

c.  Cancellation Payment

  • Cancel 7 business days or more: down payment refundable, minus any processing fees.
  • Cancel less than 7 business days: 50% of total invoice non-refundable.
  • Same-day cancellation or non-payment by 1 business day before event: 100% of total invoice.
  • Policy ensures compensation for reserved equipment that cannot be rented to others.

d.  Additional Rental Day Fees

  • Fees apply if customers are not available at pickup (Section 3).
  • Charges continue for each day rental equipment remains in customer’s possession.
  • Short-notice bookings (within 5 days of the event) remain subject to the cancellation policy, with refunds calculated minus processing fees if applicable.

10. Patio Heater Safety & Usage Agreement

a.  Usage

  • Renter agrees to follow all safety precautions to prevent accidents, injury, or damage.
  • Failure to comply may result in liability for damages or additional charges.

b. Safety Guidelines

  • Adult supervision required — only responsible adults may operate the heater.
  • Do not leave unattended — heaters must be turned off when not in use.

c.  Proper Placement & Ventilation 

  • The heater must be in an open or semi-open area with airflow.
  • Maintain safe distance from walls, ceilings, flammable materials, furniture, plants, and awnings.
  • The heater must be on a flat, level surface.
  • Close the propane tank valve completely when finished.
  • Keep the fire extinguisher nearby and ensure no flammable materials are close.

11. Trash 

a. Trash Removal Service

  • Only trash generated in rented trash cans/bags provided by Partai Rentals LLC will be removed.
  • All trash must be secured in provided bags and ready at the pickup/drop-off location.
  • Additional labor charges may apply if trash is not placed at the designated location or placement service is requested.
  • Pricing (up to 10 bags)
  • Monday–Saturday before 1:00 PM (up to 10 bags): $100
  • Monday–Friday after 3:00 PM (up to 10 bags): $150
  • Saturday after 1:00 PM, Sunday, or Federal Holidays (up to 10 bags): $200
  • Each additional trash bag exceeding 10: $5 per bag

b. Complimentary Trash Can

  • Included with every rental
  • One (1) 32-gallon trash can with lid.
  • One (1) heavy-duty trash liner.
  • Trash can remain the property of Partai Rentals LLC.
  • Must be accessible and returned at pickup.
  • Lost, damaged, or excessively soiled trash cans may incur a $50 replacement or cleaning fee.
  • Intended for customer convenience during the rental period.
